Magistrate Dismissed from Judicial Service for Misappropriation of Funds

Latiff Abubaker Nakibinge, a grade one magistrate, has been dismissed from the judicial service following allegations of misusing his authority. Nakibinge withdrew over Shs7 million intended for a litigant and refused to hand it over, leading to his conviction and subsequent dismissal by the Judicial Service Commission (JSC).

The JSC reached its decision to dismiss Nakibinge during its sitting on May 12, 2023, based on his own guilty plea. Under minute 731/JSC of 2023, Nakibinge was convicted and dismissed for abusing his authority and failing to deliver the Shs7 million to Kamugunda of Matovu and Kamugunda and Co Advocates, who were representing the defendant in a legal matter. The dismissal notice, issued on May 17, states that Nakibinge admitted to not paying the funds and had requested leniency during the disciplinary committee proceedings.

The complaint against Magistrate Nakibinge stemmed from his tenure at Rakai Court, where he allegedly withdrew funds totaling over Shs7 million from the Rakai Court Operation Fund account, which was designated for defendant costs. The Judicial Service Commission found Nakibinge’s actions to be a violation of his authority and a breach of disciplinary conduct.

In light of Nakibinge’s guilty plea and admission of not paying the funds, the JSC concluded that there were no grounds for leniency. As a result, the commission resolved to dismiss Nakibinge from the judiciary service with immediate effect. The dismissal notice emphasizes the seriousness of Nakibinge’s offense and the commission’s decision to take decisive action.
