In a significant move to address the looming TikTok ban, U.S. President-elect Donald Trump has urged the Supreme Court to delay its enforcement, seeking time to negotiate a solution that addresses national security concerns while preserving the platform. This development, detailed in a legal document filed on Friday by John Sauer, Trump’s nominee for Solicitor General, underscores Trump’s commitment to a balanced resolution.

The proposed ban stems from a law enacted in April by President Joe Biden, which mandates ByteDance, TikTok’s parent company, to divest from its U.S. operations within 270 days. Failure to comply would compel app store operators, including Apple and Google, to remove TikTok from their platforms. While the law cites national security risks as its rationale, critics, including TikTok, argue these claims are unfounded and politically motivated.

The legal filing highlights Trump’s opposition to the immediate enforcement of the TikTok ban, emphasizing his belief in negotiation over abrupt action. Known for his deal-making prowess, Trump has suggested a willingness to find a middle ground that satisfies both national security concerns and the platform’s continuity. At a Turning Point USA event in Phoenix, Arizona, Trump acknowledged TikTok’s role in engaging voters during the presidential election, hinting at a potential reprieve for the app.

TikTok’s Legal Battle

TikTok has faced relentless legal challenges since the enactment of Biden’s law. In May, the platform sued the U.S. government, arguing that the ban violates constitutional rights and would eliminate a vital medium for free speech. Earlier this month, the U.S. Court of Appeals in Washington, D.C., dismissed TikTok’s claims of unconstitutionality. However, on December 16, TikTok and ByteDance appealed to the Supreme Court, requesting a temporary halt to the law’s implementation.

In their appeal, TikTok argued that enforcing the ban on the eve of a presidential inauguration would disrupt a significant platform for political discourse, commerce, and artistic expression. On December 18, the Supreme Court agreed to review TikTok’s request, marking a crucial juncture in the ongoing saga.

The TikTok ban controversy has sparked widespread criticism and debate over its implications for free speech, international business, and U.S.-China relations. If enforced, it could set a precedent for how the U.S. government addresses perceived threats from foreign-owned digital platforms.
