High court sitting at Kampala has today sentenced and convicted Brian Bagyenda a son to ISO Boss Col Kaka Bagyenda to 32 years in prison for murdering his girlfriend Enid Twijukye who was a student of Makerere University Business School.
Justice Kazibwe also convicted and sentenced two other people who were co accused with Brian Bagyenda with the same sentence.
While giving his ruling, justice Kazibwe threw out allegations by Bagyenda’s lawyers that he was mentally abnormal by the time of committing the offense.
“Bagyenda was not mad but mentally abnormal in his senses at the time of the committal of the offense and he committed it with malice aforethought,” Justice Kazibwe’s ruling reads
Justice Kazibwe’s ruling also based on the confession statement made by Bagyenda himself at Jinja road police station in which he confessed to have killed her after finding out that she was having another man. That he tired her body and dumped it in an isolated place for it to never be recovered.
Trial judge also relied on evidence including the fact that Bagyenda sent his maid away to Kalerwe as he planned the murder, closed all his house windows and curtains and after the murder, he first disappeared to Masaka and later returned by not at his home in Luzira but hid in a hotel under a different name.
